Cadence — Terms of Service

These Terms of Service (the "Terms") govern your use of the Cadence mobile app (the "App" or "Service"), operated by Kooku (the "Developer", "we", "us"; contact: [email protected]). By downloading, signing in to, or using the App, you agree to these Terms and to our Privacy Policy. If you use the community, you also agree to the End User License Agreement & Community Guidelines.

The Korean (한국어) version follows the English text. If they conflict, the English version governs.

1. The Service

Cadence is a personal habit-coaching app for three daily habits — sleep, exercise, and reading. Core features work on your device without an account. If you sign in (with Apple, Google, or Kakao), you can back up your records and take part in the community. The App is provided for personal, non-commercial use.

Cadence provides everyday guidance and encouragement. It is not medical, psychological, or health advice, and it is not a medical device. Do not rely on it to diagnose, treat, or prevent any condition. For medical concerns, consult a qualified professional.

2. Eligibility & accounts

• You must be at least 14 years old to create an account or use the community. A neutral age check is shown before you can join.
• Signing in creates an account tied to your Apple, Google, or Kakao identity. You are responsible for keeping access to that sign-in method secure.
• You may sign out or delete your account at any time in Settings → Account. Deletion is a 30-day soft delete as described in the Privacy Policy.
• One person, one account. Do not impersonate others or misrepresent your identity.

3. Backup & sync

If you sign in, your local records are backed up to your account so you can restore them on another device. We store this backup as opaque data and do not read its contents. You are responsible for your records; we provide backup as a convenience and do not guarantee against all data loss.

4. Community & your content

• The community lets members share daily habit cards and send fixed sticker reactions. When you join, your public profile (nickname, optional avatar) and daily cards become visible to other members. Your private memos and notes are never shared.
• You keep ownership of the content you post. You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display that content solely to operate and provide the community within the App. This license ends when you delete the content or your account, except for backup copies that age out on their retention window.
• You are responsible for what you post. Do not post content you do not have the right to share.

5. Acceptable use

You agree not to:

• post content that is unlawful, harassing, hateful, threatening, sexually explicit, or otherwise objectionable (see the EULA & Community Guidelines);
• harass, abuse, impersonate, or harm other members;
• upload malware, scrape, reverse-engineer, or attempt to breach or overload the Service;
• use the Service for advertising, spam, or any commercial purpose;
• circumvent moderation (blocking, reporting, suspension) or evade a ban.

We operate a zero-tolerance policy for objectionable content and abusive users. You can report content and block users in the App; we act on reports and remove content or eject users, typically within 24 hours.

6. Moderation & termination

We may remove content, and suspend or terminate accounts, that violate these Terms or the Community Guidelines, with or without notice. You may stop using the Service and delete your account at any time. Sections that by their nature should survive termination (e.g. disclaimers, limitation of liability) will survive.

7. Changes to the Service

We may change, suspend, or discontinue features of the App at any time. The App currently has no paid subscription; if we introduce paid features in the future, they will be governed by additional terms shown at that time.

8. Disclaimers

The App is provided "as is" and "as available" without warranties of any kind, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or that data will always be preserved. Health data shown in the App is provided by Apple Health / Health Connect and may be incomplete or inaccurate.

9. Limitation of liability

To the fullest extent permitted by law, the Developer is not liable for indirect, incidental, special, or consequential damages, or for loss of data, arising from your use of the App. Nothing in these Terms limits liability that cannot be limited under applicable law (including your mandatory consumer rights).

10. Governing law

These Terms are governed by the laws of the Republic of Korea, without regard to conflict-of-laws rules, and disputes are subject to the courts having jurisdiction over the Developer's location, unless mandatory law in your country of residence provides otherwise.

11. Changes to these Terms

We may update these Terms. The "Last updated" date will change and, for material changes, we will show an in-app notice and ask signed-in users to re-accept. Continued use after the effective date means you accept the updated Terms.

Cadence는 수면·운동·독서 세 가지 습관을 위한 개인 습관 코칭 앱입니다. 핵심 기능은 계정 없이 기기에서 동작합니다. 로그인(Apple·Google·Kakao)하면 기록 백업과 커뮤니티 참여가 가능합니다. 본 앱은 개인적·비상업적 사용을 위한 것입니다.

Cadence는 일상적 가이드와 격려를 제공합니다. 의료·심리·건강에 대한 조언이 아니며, 의료기기가 아닙니다. 어떤 질환의 진단·치료·예방에 의존하지 마세요. 의료 문제는 전문가와 상담하세요.

2. 이용 자격·계정

• 계정 생성 및 커뮤니티 이용은 만 14세 이상이어야 합니다. 참여 전 중립 연령 확인이 표시됩니다.
• 로그인은 Apple·Google·Kakao 신원에 연결된 계정을 만듭니다. 해당 로그인 수단의 접근 보안은 사용자 책임입니다.
• 언제든 설정 → 계정에서 로그아웃하거나 계정을 삭제할 수 있습니다. 삭제는 개인정보처리방침에 기재된 30일 소프트 삭제입니다.
• 1인 1계정. 타인을 사칭하거나 신원을 허위 표시하지 마세요.

3. 백업·동기화

로그인하면 로컬 기록이 계정에 백업돼 다른 기기에서 복원할 수 있습니다. 백업은 불투명 데이터로 저장되며 당사는 내용을 읽지 않습니다. 기록의 책임은 사용자에게 있으며, 백업은 편의 제공일 뿐 모든 데이터 손실을 보장하지 않습니다.

4. 커뮤니티·게시물

• 커뮤니티에서는 일일 습관 카드를 공유하고 고정 스티커 반응을 보낼 수 있습니다. 참여 시 공개 프로필(닉네임·선택적 아바타)과 일일 카드가 다른 회원에게 보입니다. 개인 메모·노트는 절대 공유되지 않습니다.
• 게시물의 소유권은 사용자에게 있습니다. 사용자는 커뮤니티를 앱 내에서 운영·제공하기 위한 목적에 한해 해당 콘텐츠를 호스팅·저장·복제·표시할 수 있는 전 세계·비독점·무상 라이선스를 당사에 부여합니다. 이 라이선스는 콘텐츠나 계정을 삭제하면 종료됩니다(보존 기간에 따라 소멸하는 백업 사본 제외).
• 게시 내용에 대한 책임은 사용자에게 있습니다. 공유 권리가 없는 콘텐츠를 올리지 마세요.

5. 이용 규칙

다음 행위를 하지 않기로 동의합니다:

• 불법·괴롭힘·혐오·위협·성적으로 노골적이거나 그 밖에 부적절한 콘텐츠 게시(EULA·커뮤니티 가이드라인 참조);
• 다른 회원 괴롭힘·학대·사칭·가해;
• 악성코드 업로드, 스크래핑, 역공학, 서비스 침해·과부하 시도;
• 광고·스팸·상업적 목적 사용;
• 모더레이션(차단·신고·정지) 회피 또는 밴 우회.

당사는 부적절한 콘텐츠 및 악성 이용자에 대해 무관용 정책을 운영합니다. 앱에서 콘텐츠를 신고하고 이용자를 차단할 수 있으며, 당사는 신고에 대응해 통상 24시간 내에 콘텐츠를 제거하거나 이용자를 배제합니다.

6. 모더레이션·해지

당사는 본 약관이나 커뮤니티 가이드라인을 위반하는 콘텐츠를 제거하고 계정을 정지·해지할 수 있으며, 사전 통지 여부는 상황에 따릅니다. 사용자는 언제든 이용을 중단하고 계정을 삭제할 수 있습니다. 성질상 존속해야 하는 조항(면책·책임 제한 등)은 해지 후에도 존속합니다.

7. 서비스 변경

당사는 앱 기능을 언제든 변경·중단·종료할 수 있습니다. 현재 앱에는 유료 구독이 없습니다. 향후 유료 기능을 도입하면 그때 표시되는 추가 약관의 적용을 받습니다.

8. 면책

앱은 관련 법이 허용하는 최대 범위에서 "있는 그대로", "이용 가능한 상태로" 어떤 종류의 보증도 없이 제공됩니다. 서비스의 무중단·무오류·데이터 보존을 보증하지 않습니다. 앱에 표시되는 건강 데이터는 Apple 건강 / Health Connect가 제공하며 불완전·부정확할 수 있습니다.

9. 책임 제한

관련 법이 허용하는 최대 범위에서, 당사는 앱 사용으로 인한 간접·부수적·특별·결과적 손해 또는 데이터 손실에 대해 책임지지 않습니다. 본 약관은 관련 법상 제한할 수 없는 책임(강행 소비자 권리 포함)을 제한하지 않습니다.

10. 준거법

본 약관은 국제사법 원칙과 무관하게 대한민국 법의 적용을 받으며, 거주국의 강행법이 달리 정하지 않는 한 분쟁은 당사 소재지 관할 법원에 따릅니다.

11. 약관 변경

당사는 본 약관을 갱신할 수 있습니다. "최종 갱신" 날짜가 바뀌며, 중대한 변경 시 앱 내 안내를 표시하고 로그인 사용자에게 재동의를 요청합니다. 효력일 이후 계속 사용하면 갱신 약관에 동의하는 것으로 간주됩니다.
